JMS warrants to the purchaser that all new recreational solutions, parts and accessories manufactured by it (“Equipment”) are free from defects in material and workmanship occurring during the normal use and resulting from use within rated capacities and intended usage.
JMS’s obligation under this warranty is limited to repair or replacement, at JMS’s sole option, for a period of two years after date of original delivery any equipment found by JMS to be defective. All repairs shall be made only at JMS’s factory location or at a JMS designated service center unless pre-authorized in writing by JMS. JMS’s obligation under this warranty is conditional upon its right to examine the defective equipment or parts prior to the start of any repairs and does not extend to any altered equipment or unauthorized repairs.
This warranty does not cover damage due to accident, negligence, fire or other calamities, acts of God, modifications, improper use, misuse, overloading or mechanical damage, abuse, chemicals, road hazards, or normal wear, tear or deterioration.
JMS expressly disclaims any liability arising out of the negotiation, execution and sale or use of the equipment for any incidental or consequential damages such as, but not limited to, damage or loss of other property or equipment, loss of profits or revenues, downtime, transportation expenses due to repairs, cost of replacement goods or claims for business interruptions. This warranty is exclusive. JMS disclaims any expressed or implied warranty of merchantability, fitness for a particular purpose or other warranty of quality.
No representative of JMS, nor any of its sales and service agents has the authority to change, modify, or extend this warranty in any manner, nor have the authority to make any express warranty with respect to the Equipment. By acceptance of the Equipment, purchaser acknowledges that no representations, either oral or written, have been given or made by representatives of JMS or its sales and service agents and purchaser has not relied on any such representations in the purchase of the Equipment.
This warranty is nontransferable and not assignable, insuring only to the benefit of the original purchaser of the Equipment. This warranty does not expand or enlarge upon the warranties provided by other manufacturers and suppliers of parts and accessories, which may be a part of the Equipment.
JMS reserves the right to make changes in design or improvements to the Equipment without notice and without any obligation to provide parts for or to make modifications to previously manufactured Equipment.
